This is the version that shipped with Nightjar Browser 0.2.5. The current one is at /terms.html.
Status: draft. Not legal advice. These terms were written against what the
software actually does. They have not been reviewed by a lawyer, §8 and §13
still depend on an entity and a jurisdiction that are not settled, and the
placeholders marked […] must be filled in before publishing.
These terms cover using the software. LICENSE covers the software itself and
its source; PRIVACY.md covers what it does with your data. The three are
meant to be read together and must not contradict each other.

By installing or using Nightjar Browser ("the Software") you agree to these terms. If you do not agree, do not install or use it.
There is no account and no registration. Your agreement is signalled by use.
Subject to these terms, you are granted a personal, non-exclusive, non-transferable licence to install and use the Software on devices you control.
The Software is proprietary and all rights in it are reserved. LICENSE sets
out what may and may not be done with the software and its source; it grants no
right to copy, modify or redistribute, and it narrows nothing in this section.
Where the two are read together, this section is the permission to use and
LICENSE is the limit on everything else.
Third-party components inside the Software remain under their own licences,
which this section does not touch — see §5 and LICENSE §5.
You may not: remove or obscure notices; use the Software to break the law; or represent the Software as your own product.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
In particular, and without limiting the above, no warranty is given that:
The assistant runs a local language model. Language models produce confident text that is sometimes wrong. Output may be inaccurate, outdated, biased, or fabricated, and must not be relied on for medical, legal, financial, or other professional decisions. You are responsible for checking anything you act on.
The assistant can, at your instruction, read the page you are viewing, act on your behalf in the browser, and write text into form fields. You are responsible for what it does under your instruction, including anything it submits.
The Software downloads and runs third-party components, at your request:
llama.cpp inference binaries, from their official releases.We do not publish, endorse, or take responsibility for these, or for any website you visit through the Software.
The Software blocks advertising and tracking requests by default. This may breach the terms of service of some websites, may cause sites to malfunction, and may deprive publishers of revenue. You choose whether to run it, and you accept that responsibility. Blocking can be disabled globally or per site.
You must not use the Software to access material that is illegal where you are, to attack or disrupt any service, to circumvent access controls you are not entitled to bypass, or to automate activity on a website in breach of that site's terms.
To the maximum extent permitted by law, in no event shall the authors or copyright holders be liable for any claim, damages, or other liability, whether in an action of contract, tort, or otherwise, arising from, out of, or in connection with the Software or its use — including loss of data, loss of profits, business interruption, or the consequences of anything the AI assistant produced or did.
Where liability cannot lawfully be excluded, it is limited to the amount you paid for the Software, which for a free distribution is zero.
Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
See PRIVACY.md. In summary: the Software has no servers and collects nothing.
Update checks run only when you ask for them. You choose whether to install any update. Old versions may stop working with third-party services without notice.
This licence ends if you stop using the Software or breach these terms. Delete the application and its data folder to remove it entirely.
These terms may change; material changes will be noted with a new date. Because there is no account, there is no way to notify you individually. Continuing to use the Software after a change means accepting it.
